By registering for the Trident Fitness Challenge, I (“Releasor”) acknowledge that I have voluntarily elected to participate in the Trident Fitness Challenge and all other activities relating to it (the “Services”), which Services are being sponsored by Trident Freedom Foundation (“TFF”).

I understand and expressly agree that there are risks inherent in physical activity and my use of the Services may involve potentially dangerous physical activities that may lead to minor injuries or major injuries, up to and including death. In consideration for my participation in the Services, I understand and voluntarily accept full responsibility for the risk of injury or loss arising out of or related to my use of the Services. I further agree that TFF, and its respective affiliated entities, officers, directors, employees, volunteers, agents, and independent contractors (collectively, the “TFF Group”) will not be liable for any injury including, without limitation, personal, bodily, or mental injury, disability, death, economic loss, or any damage to me, my spouse or domestic partner, unborn child, heirs, or relatives resulting from the negligent conduct or omission of any member of the TFF Group or anyone acting on their behalf, in connection with the Services.

I represent that I am physically able to participate in the Trident Fitness Challenge and have not been advised by a physician to refrain from strenuous physical activity. I understand it is my responsibility to consult a physician before participating if I have any medical concerns.

To the fullest extent permitted by law, I hereby forever release, waive, and discharge each member of the TFF Group from any and all claims, demands, injuries, damages, actions, or causes of action related to my use of the Services (collectively, “Claims”) against any member of the TFF Group, or anyone acting on their behalf. Further, I hereby agree to defend, indemnify, and hold harmless each member of the TFF Group from and against all liabilities, claims, damages, and expenses (including reasonable attorney’s fees and costs) arising from or related to any such Claims.

Participants may complete the Trident Fitness Challenge at independently selected locations. TFF does not own, operate, supervise, inspect, or control these facilities and assumes no responsibility for the condition, safety, equipment, or operation of any third-party location.

Participants are solely responsible for ensuring that any equipment or workout area they choose to use is safe and appropriate for participation.

In the event that I file a lawsuit against any member of the TFF Group, no matter how described or designated, I agree to do so solely in Tarrant County, Texas, and I further agree that the substantive law of the State of Texas shall apply in said action without regard to the conflict of law rules of that state or any other state. This Agreement applies to my participation in Services sponsored by TFF regardless of the state or location in which those Services take place.

By registering, I acknowledge that if I am injured in connection with the Services, I may be found by a court of law to have waived my right to maintain a lawsuit against members of the TFF Group on the basis of any claim from which I have released them herein.

I authorize the TFF Group to secure and consent to any emergency medical treatment, first aid, or transportation to a medical facility that may be deemed necessary for me (or, if applicable, for a minor Releasor registered under my account) in the event I am unable to give consent myself due to injury or incapacitation. I understand that TFF does not provide medical or health insurance coverage for participants, and I agree that I am solely responsible for any costs of medical treatment arising from my participation in the Services.

I acknowledge and agree that TFF retains the absolute and irrevocable right and permission, without any additional compensation or recognition given to me, with respect to any photographs, videos, and audio recordings in its possession (whether produced by TFF staff or provided to TFF by me or others) that may include me in any way. I further agree that TFF may copyright the same in TFF’s name or any other name that TFF may choose. I authorize TFF to use, reuse, publish, and republish the same, in whole or in part, individually or in conjunction with any other photographs, videos, and/or audio recordings, in any medium and for any purpose whatsoever, including, without limitation, illustration, ministry, marketing, advertising, and trade (including, without limitation, advertisements, books, brochures, cards, calendars, invitations, social media posts, and websites).

If any provision of this Agreement, or the application of any provision to any person or circumstance, is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable in whole or in part for any reason, the remaining provisions, and the remainder of any partially unenforceable provision, shall nevertheless continue in full force and effect, and shall be enforced to the fullest extent permitted by applicable law.

Registration fees and donations are non-refundable except in the sole discretion of TFF. Event dates, formats, or locations may be modified as necessary. If the event is canceled by TFF, participants will be notified regarding available options.

If I am registering additional participants, I certify that I have informed them of this waiver and that I have authority to provide their registration information. I understand each participant remains responsible for accepting this waiver if required by TFF.
